The Mental Capacity Act 2005 provided for a new Court of Protection to make decisions in relation to the property, financial affairs and personal welfare of adults (and children in some cases) who lack mental capacity.

The application process can be quite a lengthy and complicated one. If any objections are raised then a full hearing may need to take place.
