Contesting a Will

Challenging the validity of a Will is a common and stressful process. The nature of these disputes are often emotional due to the recent loss of a loved one and distraught family members are less inclined to act sensibly, hence why it is important to seek expert advice at the earliest opportunity. There are also strict time limits involved in contesting the validity of a Will or the Rules of Intestacy.

There are a number of grounds upon which a Will dispute occurs; these include where it is alleged that the deceased did not have capacity at the time of making their Will, or did not understand or approve the content of the Will or where the Will is fraudulent. The distribution of the estate be it through a Will or the Rules of Intestacy in the absence of a Will, can also be challenged if a person was not reasonably provided for from the estate.
